Digital downloads<\/h2><p>Digital products include, but are not limited to:<\/p><ul data-spread=\"false\"><li>Sample packs;<\/li><li>Audio files;<\/li><li>Presets;<\/li><li>Project files;<\/li><li>Patcher tools;<\/li><li>Software;<\/li><li>Plugins;<\/li><li>Licence keys;<\/li><li>Other downloadable content.<\/li><\/ul><p class=\"isSelectedEnd\">Consumers generally have the right to withdraw from an online purchase of digital content within 14 days of entering into the agreement, unless the right of withdrawal has validly expired under applicable law.<\/p><p>\u00a0<\/p><p class=\"isSelectedEnd\">Erato Studio currently provides digital downloads immediately without requiring customers to waive their statutory right of withdrawal. This means that downloading or accessing the digital product does not, by itself, remove the consumer\u2019s right to withdraw within the applicable 14-day withdrawal period.<\/p><p>\u00a0<\/p><p class=\"isSelectedEnd\">To exercise the right of withdrawal, the customer must notify Erato Studio before the withdrawal period expires by using the available online withdrawal function or by contacting <a href=\"mailto:info@eratostudio.com\">info@eratostudio.com<\/a>.<\/p><p>\u00a0<\/p><p class=\"isSelectedEnd\">When a customer validly withdraws from the agreement, Erato Studio will refund the amount paid using the original payment method, unless another method is expressly agreed.<\/p><p>\u00a0<\/p><p class=\"isSelectedEnd\">After withdrawing from the agreement, the customer must stop using the digital content and may not share, distribute, publish, sell, or otherwise make it available to another person.<\/p><p>\u00a0<\/p><p>The right of withdrawal is separate from the customer\u2019s statutory rights when digital content is defective, incomplete, incompatible with the stated requirements, or otherwise does not conform to the agreement.<\/p><h2>3. Free digital products<\/h2><p>Some digital products are offered free of charge.<\/p><p>Where no purchase price was paid, there is no payment to refund. However, if a free digital product does not work as reasonably expected or does not match its description, please contact us so that we can provide an appropriate solution where legally required.<\/p><p>\u00a0<\/p><p>Newsletter consent is separate from acceptance of the conditions for a free download. Unless expressly and lawfully stated otherwise, you do not have to subscribe to marketing communications to receive a free product.<\/p><p>\u00a0<\/p><h2>4. Mixing, mastering, and other services<\/h2><p>You generally have 14 days from entering into an online service agreement to withdraw from that agreement.<\/p><p>If you expressly request that we begin providing the service during the withdrawal period and you later withdraw before the service is completed, we may charge a proportionate amount for the work already performed.<\/p><p>Your right of withdrawal may expire once the service has been fully performed where:<\/p><ol start=\"1\" data-spread=\"false\"><li>You expressly requested that performance begin during the withdrawal period;<\/li><li>You agreed that the service could be completed during that period; and<\/li><li>You acknowledged that you would lose the right of withdrawal once the service was fully performed.<\/li><\/ol><p>Custom work that has already been delivered remains covered by your statutory rights if it was not carried out as agreed.<\/p><h2>5. Ownership<\/h2>\n<p class=\"isSelectedEnd\">Erato Studio products and their contents are copyrighted works owned by Erato Studio or its licensors.<\/p>\n<p class=\"isSelectedEnd\">The purchase or authorised download of a product does not transfer ownership or copyright to you.<\/p>\n<p class=\"isSelectedEnd\">All rights not expressly granted under this Licence Agreement remain with Erato Studio and its licensors.<\/p>\n<h2>2. Licence grant<\/h2>\n<p class=\"isSelectedEnd\">After purchasing or legitimately obtaining an Erato Studio product, you are granted a:<\/p>\n<ul data-spread=\"false\">\n<li>Non-exclusive;<\/li>\n<li>Non-transferable;<\/li>\n<li>Non-sublicensable;<\/li>\n<li>Single-user<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">licence to use the product for personal or commercial music-production purposes, subject to this Licence Agreement.<\/p>\n<p class=\"isSelectedEnd\">This licence continues unless it is terminated in accordance with these terms.<\/p>\n<p class=\"isSelectedEnd\">Free products are covered by the same licence unless different terms are clearly stated for the relevant product.<\/p>\n<h2>3. Permitted use of sample packs<\/h2>\n<p class=\"isSelectedEnd\">You may use sounds from an Erato Studio sample pack in your own original musical productions, including:<\/p>\n<ul data-spread=\"false\">\n<li>Commercially released music;<\/li>\n<li>Non-commercial music;<\/li>\n<li>Live performances;<\/li>\n<li>Videos;<\/li>\n<li>Films;<\/li>\n<li>Games;<\/li>\n<li>Podcasts;<\/li>\n<li>Advertisements;<\/li>\n<li>Other audiovisual productions.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">You may edit, process, layer, mix, and combine the sounds with other material as part of a larger original production.<\/p>\n<p class=\"isSelectedEnd\">You may distribute and commercially exploit your finished production, provided that the Erato Studio content is not distributed separately, substantially unchanged, or in a form that allows another person to extract and reuse it as a sample library.<\/p>\n<h2>4. Permitted use of plugins and software<\/h2>\n<p class=\"isSelectedEnd\">You may install and use a purchased plugin or software product on up to 3&nbsp;devices that you personally own or control.<\/p>\n<p class=\"isSelectedEnd\">The licence is issued to one individual user. Companies, teams, educational institutions, and studios with multiple users must obtain a separate licence for each user unless Erato Studio agrees otherwise in writing.<\/p>\n<p class=\"isSelectedEnd\">You may use the output created with the plugin or software in personal and commercial musical productions.<\/p>\n<h2>5. Licence keys<\/h2>\n<p class=\"isSelectedEnd\">A licence key may only be used by the person or organisation to whom it was legitimately issued.<\/p>\n<p class=\"isSelectedEnd\">You may not:<\/p>\n<ul data-spread=\"false\">\n<li>Share a licence key with another person;<\/li>\n<li>Publish a licence key online;<\/li>\n<li>Sell, rent, lend, transfer, or sublicense a licence key;<\/li>\n<li>Use a licence key obtained through an unauthorised source;<\/li>\n<li>Circumvent, disable, or interfere with licence-verification systems;<\/li>\n<li>Create or use an unauthorised or pirated copy of an Erato Studio product.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Sharing includes in-person sharing, private online sharing, public sharing, account sharing, and distribution through file-sharing services.<\/p>\n<p class=\"isSelectedEnd\">Erato Studio may deactivate a licence key where there is reasonable evidence that it has been shared, stolen, fraudulently obtained, or used in material breach of this Licence Agreement.<\/p>\n<p class=\"isSelectedEnd\">Where reasonably possible, we may contact the registered customer before deactivation and provide an opportunity to explain the circumstances.<\/p>\n<h2>6. Prohibited distribution<\/h2>\n<p class=\"isSelectedEnd\">You may not distribute, sell, rent, lend, upload, sublicense, or share an Erato Studio product or any of its contents:<\/p>\n<ul data-spread=\"false\">\n<li>As an individual file;<\/li>\n<li>As part of another sample pack;<\/li>\n<li>As part of another audio library;<\/li>\n<li>As a preset collection;<\/li>\n<li>As a sound-design resource;<\/li>\n<li>As part of another plugin or software product;<\/li>\n<li>Through a file-sharing service;<\/li>\n<li>Through a shared account or download folder;<\/li>\n<li>In any form that allows third parties to access or reuse the original content.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">You may not use an Erato Studio product to create a directly competing sample pack, preset pack, audio library, plugin, or software product containing the original or substantially reproduced content.<\/p>\n<h2>7. Copying, modification, and reverse engineering<\/h2>\n<p class=\"isSelectedEnd\">You may make reasonable backup copies solely for your own use.<\/p>\n<p class=\"isSelectedEnd\">Except where mandatory law expressly permits it, you may not:<\/p>\n<ul data-spread=\"false\">\n<li>Copy or reproduce the product for another person;<\/li>\n<li>Reverse engineer, decompile, or disassemble a plugin or software product;<\/li>\n<li>Remove or alter copyright, trademark, licence, or ownership notices;<\/li>\n<li>Modify the product for the purpose of redistributing or reselling it;<\/li>\n<li>Reproduce or distribute a substantially identical copy of the product;<\/li>\n<li>Circumvent technical protection or licensing measures.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Nothing in this section prohibits normal sound processing, editing, mixing, or creative use of samples within a finished musical production.<\/p>\n<h2>8. Ownership of your productions<\/h2>\n<p class=\"isSelectedEnd\">You retain ownership of the original musical productions you create, subject to the rights of any third parties whose material you use.<\/p>\n<p class=\"isSelectedEnd\">Erato Studio retains ownership of the underlying sample files, software, plugin code, graphics, presets, documentation, and other protected product content.<\/p>\n<p class=\"isSelectedEnd\">You may not claim that you created or own the original Erato Studio product or its individual source materials.<\/p>\n<h2>9. Compatibility and system requirements<\/h2>\n<p class=\"isSelectedEnd\">Before purchasing or downloading a product, you are responsible for checking the stated:<\/p>\n<ul data-spread=\"false\">\n<li>Operating-system requirements;<\/li>\n<li>Plugin format;<\/li>\n<li>Software version;<\/li>\n<li>Digital audio workstation compatibility;<\/li>\n<li>Hardware requirements;<\/li>\n<li>Installation instructions.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Compatibility with software, operating systems, or hardware that is not listed on the relevant product page is not guaranteed.<\/p>\n<p class=\"isSelectedEnd\">Erato Studio may provide updates, bug fixes, or compatibility improvements where reasonably appropriate. Unless expressly agreed otherwise, this does not create an obligation to support every future version of third-party software, hardware, or operating systems indefinitely.<\/p>\n<p class=\"isSelectedEnd\">Your mandatory legal rights relating to digital products remain unaffected.<\/p>\n<h2>10. Support<\/h2>\n<p class=\"isSelectedEnd\">Technical support is provided through <a href=\"mailto:info@eratostudio.com\">info@eratostudio.com<\/a> or another support method stated on our website.<\/p>\n<p class=\"isSelectedEnd\">When requesting support, you may be asked to provide:<\/p>\n<ul data-spread=\"false\">\n<li>Proof of purchase;<\/li>\n<li>Your licence information;<\/li>\n<li>Your operating system;<\/li>\n<li>Your software or DAW version;<\/li>\n<li>Screenshots;<\/li>\n<li>Error messages;<\/li>\n<li>Other information reasonably necessary to investigate the problem.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Support does not cover problems caused solely by unsupported systems, unauthorised modifications, piracy, or third-party products that are outside Erato Studio\u2019s control.<\/p>\n<h2>11. Termination<\/h2>\n<p class=\"isSelectedEnd\">Erato Studio may terminate this licence if you materially breach this Licence Agreement and, where the breach can reasonably be corrected, you fail to correct it after receiving notice.<\/p>\n<p class=\"isSelectedEnd\">The licence may be terminated immediately in cases involving:<\/p>\n<ul data-spread=\"false\">\n<li>Piracy;<\/li>\n<li>Intentional licence-key sharing;<\/li>\n<li>Fraud;<\/li>\n<li>Unauthorised resale or distribution;<\/li>\n<li>Deliberate circumvention of technical protection measures.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">When the licence is terminated, you must stop using the affected product and delete all copies in your possession or control.<\/p>\n<p class=\"isSelectedEnd\">Termination does not affect finished musical productions that were lawfully created and distributed before termination, unless continued use would involve an ongoing infringement or unlawful distribution of the underlying product.<\/p>\n<h2>12. Defective products and statutory rights<\/h2>\n<p class=\"isSelectedEnd\">Nothing in this Licence Agreement excludes or limits any mandatory rights that you have under applicable consumer law.<\/p>\n<p class=\"isSelectedEnd\">If a product is defective, does not match its description, or does not provide the functionality that you may reasonably expect based on the agreement, contact <a href=\"mailto:info@eratostudio.com\">info@eratostudio.com<\/a>.<\/p>\n<p class=\"isSelectedEnd\">Where legally required, Erato Studio will provide an appropriate remedy, which may include repair, replacement, an update, a price reduction, or a refund.<\/p>\n<h2>13. Limitation of liability<\/h2>\n<p class=\"isSelectedEnd\">To the extent permitted by law, Erato Studio is not liable for indirect or consequential losses resulting from the use or inability to use a product, including loss of projects, data, revenue, opportunities, or business interruption.<\/p>\n<p class=\"isSelectedEnd\">You are responsible for maintaining appropriate backups of projects, presets, audio files, and other important data.<\/p>\n<p class=\"isSelectedEnd\">Nothing in this Licence Agreement excludes or limits liability where such exclusion is not legally permitted, including liability resulting from intentional misconduct or gross negligence.<\/p>\n<h2>14. Changes to this Licence Agreement<\/h2>\n<p class=\"isSelectedEnd\">Erato Studio may update this Licence Agreement to reflect changes in products, technology, security requirements, or applicable law.<\/p>\n<p class=\"isSelectedEnd\">Changes will not unreasonably remove rights already granted under a paid licence.<\/p>\n<p class=\"isSelectedEnd\">The version accepted at the time of purchase will generally continue to apply to that purchase, except where a change is required by law, necessary for security, or expressly accepted by you.<\/p>\n<h2>15. Applicable law<\/h2>\n<p class=\"isSelectedEnd\">This Licence Agreement is governed by Dutch law.<\/p>\n<p class=\"isSelectedEnd\">If you are a consumer living in another country, this choice of law does not remove any mandatory consumer protection provided by the laws of your country of residence.<\/p>\n<p class=\"isSelectedEnd\">Disputes may be submitted to the competent Dutch court, unless mandatory consumer law allows you to bring a claim before another competent court.<\/p>\n<h2>16.
